Supreme Court Upholds Violent Game Ban Decision

In an interesting turn out, the Washington Supreme Court have ruled that California’s move to restrict the sale or rental of games to children is in violation of a minor’s rights under the First Amendment.  A federal appeal court decision to overturn the state ban was upheld by the high court, with Justice Antonin Scalia stating that: “No doubt a state possesses legitimate power to protect children from harm, but that does not include a free-floating power to restrict the ideas to which children may be exposed.”

Scalia went on to point put that in the US, children’s access to depictions of violence has traditionally been unrestricted, citing examples from popular (original)  fairy tales such as Snow White and Hansel and Gretel.  “Certainly the books we give children to read — or read to them when they are younger — contain no shortage of gore.”
